Growth Mindset AI provides AI-powered voice agent and automation services designed to help businesses answer phone calls, qualify leads, and book appointments. Services are provided on a subscription basis as described at the time of purchase.
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business. By using our services, you represent that you meet these requirements.
We offer a 14-day free trial for new customers. No credit card is required to start the trial. If you do not cancel before the trial period ends, you will be automatically enrolled in the monthly subscription at the then-current rate. You may cancel at any time before the trial ends with no charge.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to the service until that date. We do not provide prorated refunds for partial months.

You are solely responsible for ensuring your use of our AI voice agent complies with all applicable federal, state, and local laws governing telephone calls, including but not limited to the Telephone Consumer Protection Act (TCPA), FCC regulations, and applicable state call recording disclosure laws. We recommend disclosing to callers that they may be interacting with an AI system where required by law.
All content, software, and technology comprising our services are owned by Growth Mindset AI or our licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use our services for your internal business purposes only.
You retain ownership of any content, scripts, or data you provide to configure our services. By providing such content, you grant us a limited license to use it solely to deliver our services to you. You represent that you have the rights to any content you provide and that it does not violate any third-party rights.
Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or achieve any particular result for your business. Results vary and are not guaranteed. Revenue figures and ROI estimates referenced in our marketing materials are illustrative examples based on industry data, not guarantees of specific outcomes.
To the maximum extent permitted by applicable law, Growth Mindset AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue, arising out of or related to your use of our services, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the three months preceding the claim.
You agree to indemnify and hold harmless Growth Mindset AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our services, your violation of these Terms, or your violation of any applicable law.
We reserve the right to suspend or terminate your access to our services at any time, with or without notice, if we believe you have violated these Terms or if continued service would expose us to legal liability.
These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Florida, and you consent to personal jurisdiction in such courts.
We may update these Terms from time to time. We will notify active subscribers of material changes by email. Continued use of our services after the effective date of changes constitutes acceptance of the updated Terms.
